We are Upstix Technologies Limited (referred to as “Upstix”, “we”, “us” or “our” in this policy), a company providing data and technology solutions with company registration number 13180792. This policy sets out how we use and protect any personal data we obtain about people who use this website, who contact us to seek an offer for their property, who buy or consider buying property from us, who register as an investor, who receive or submit property offers, or who otherwise interact with us in connection with buying or selling property through our platform. Upstix is the controller of this information, which means we are responsible for determining how it is used. Upstix is registered with the Information Commissioner’s Office under registration number ZB295950.

2. The information we collect and process

We collect information about you when you fill in our online enquiry form, use our website, or correspond with us by email, phone or post, and from events you attend.

If you decide to proceed with a property transaction with us, we may also collect information about you from estate agents, surveyors, solicitors and other professional service providers appointed in connection with the transaction. They may obtain information about you from various sources including public registers and identity verification companies. They are responsible for the information they collect and you should consult their own privacy policies.

The personal data we typically collect about you may include:

  • Identity data including your name, date of birth, gender and details on your passport or other photographic identification.
  • Contact data including your contact number, email address and property address.
  • Financial data including your bank account, income and payment card details.
  • Technical data including your IP address, device ID, login data and browser type and version.
  • Profile data including your username and password, interests, preferences, feedback and survey responses.
  • Usage data including information about how you use the website.
  • Marketing and communications data including your preferences for receiving marketing from us and from third parties.
  • Property data including information about the property you wish to sell or buy.

For people who register with us as property investors, submit offers on referred properties, or otherwise use our investor services, we may also collect company data (company name, registration number, directors and authorised signatories), proof and source of funds, anti-money laundering and know-your-customer documentation, and offer and transaction data. We collect this directly from you, from publicly available sources such as Companies House, and from third-party verification providers where compliance requires it.

Website usage information is also collected using cookies and similar technologies, and phone calls to and from us may be recorded for training, monitoring and record keeping.

3. Lawful basis for processing your information

We will only use your personal data when the law allows us to. Most commonly this is:

  • Where you have asked us to, or consented to us doing so, including for certain marketing communications.
  • Where we need to perform a contract we have entered into with you, or to take steps at your request to enter into one.
  • Where it is necessary for our legitimate interests, or those of a third party, including operating and improving our business, preventing circumvention, protecting commercial interests and facilitating property transactions, and your fundamental rights do not override those interests.

4. What we do with the information we gather

  • Register your details and deliver the service you request, decide whether to make or withdraw an offer to buy or sell a property, and perform any property transaction with you.

5. Our use of AI agents

When you first register your details on our website, we may use an AI agent to have an initial conversation with you so we can better understand the circumstances of your sale. Where the AI agent determines that you meet our criteria, your details are passed to our sales team, who will get in contact with you.

The AI agent qualifies your proposed valuation in real time using on-market data and property listing history. This process is automated, but you can request a second valuation from a member of our team at any stage.

Through the AI agent we may collect personal data including your name, contact information, property details and financial situation, and use it both for qualification decisions and to improve the performance of the agent. We may share your data with third-party partners such as estate agents, financial advisers and mortgage brokers if you have told the agent you could benefit from those services.

6. How we use cookies

A cookie is a small file placed on your device. Cookies help us analyse web traffic, recognise your device and distinguish you from other users, so the site can adapt to your preferences.

We use traffic log cookies to identify which pages are being used. This helps us analyse webpage traffic and improve the website. We only use that information for statistical analysis, after which the data is removed from the system.

You can choose to accept or decline cookies. Most browsers accept them automatically, but you can change your browser settings to decline them. Doing so may stop you taking full advantage of the website.

7. Links to other websites

Our website may contain links to other sites. We will not market to you directly for longer than three years from when we first collected your information, unless you opt in again before that period expires. We may share your information with colleagues within Upstix and with trusted service providers we have a contractual relationship with, where they help us manage our relationship with you or perform transactions with you. We check they have the necessary data protection policies and procedures in place.

Our service providers give us administrative, statistical, marketing, profiling, technical, conveyancing and legal services, including surveyors, solicitors, valuation firms, panel managers and analytics providers. We only give them the amount of personal data they need, and we require them to protect it. Some act as data processors on our instructions; others are data controllers responsible directly to you for their use of the data, and may be obliged to give you further information about how and why they process it.

For investor data, we may also share personal data with:

  • Vendors and their professional advisers, where needed to facilitate a transaction.
  • Solicitors and other advisers involved in a property transaction.
  • Anti-money laundering and identity verification providers.
  • IT and platform service providers.
  • Regulatory authorities, law enforcement agencies or courts where the law requires it.

With your consent we may share your information with selected third-party organisations who may use it for their own marketing and associated purposes. Those organisations operate in sectors including retail, real estate, legal services, automotive, lifestyle, utilities, telecoms, insurance, publishing and media, entertainment and leisure, the public sector, financial services, and marketing agencies and brokers. We may also share your personal data:

  • If the law or a public authority says we must, or law enforcement bodies or public authorities request it and we consider the law permits us to provide it.
  • To establish, exercise or defend our legal rights, including providing data to others for preventing fraud and reducing credit risk.
  • To an organisation we sell or transfer part of our business to, or enter negotiations with. If a sale goes ahead, the organisation receiving your data can use it in the same way as us.
  • To any other successors in title to our business.

The servers where we store your personal data are located in the UK or the European Economic Area. We do not generally transfer your data outside that area.

If you fail to provide personal data

Where we need to collect personal data by law, or under the terms of a contract with you, and you do not provide it when asked, we may not be able to perform the contract we have or are trying to enter into with you.

11. Your rights over your personal data

Under data protection law you have rights over how we process your personal data. There is no charge for exercising them. We have one month to respond, and you may be asked for ID to confirm your identity.

  • Right of access – you can ask us for copies of your personal information. This right always applies, though some exemptions mean you may not always receive everything we process.
  • Right of rectification – you can ask us to correct information you think is inaccurate, or complete information you think is incomplete.
  • Right to be forgotten – in certain circumstances you can ask for the data we hold about you to be erased from our records.
  • Right to restriction of processing – where certain conditions apply you can ask us to restrict how we process your data.
  • Right of portability – you can ask for the data we hold about you to be transferred to another organisation.
  • Right to object – you can object to certain types of processing, such as direct marketing.
  • Rights related to automated decision-making and profiling – we do not use automated decision-making that would have a potentially damaging effect on you.
  • Right to withdraw consent – where we rely on your consent, you can withdraw it at any time. That does not affect the lawfulness of processing before you withdrew it, and we may not be able to provide certain services afterwards. We will tell you if that is the case.
